State will appeal education tax-credit ruling to MT Supreme Court

A state court has voided a Revenue Department rule that said students attending private, religious schools in Montana can’t benefit from a new state education tax credit.

But the state’s top revenue official told MTN News Thursday the state will appeal the ruling to the Montana Supreme Court.

State Revenue Director Mike Kadas said the agency believes the tax credit is an "indirect payment" – and that the state constitution forbids any such payment to sectarian, or religious, organizations.
