High court allows Paws Up foreclosure in Montana

A decade-long battle over an $800,000 construction lien against the owner of the 10,000-acre Paws Up http://www.pawsup.com/ ranch complex near Greenough may have neared its end last week with a unanimous decision by the Montana Supreme Court allowing a Montana construction company to collect the debt or foreclose on the property.

The court on Tuesday said the owner of Paws Up used a "shell" corporation to try to insulate itself from the debt. If such an arrangement were adopted by others, "there would be no enforceable construction liens," Montana Chief Justice Mike McGrath wrote for the five-judge panel.
