Montana ad raises issue: Can you be charged with DUI on a horse?
A Montana public service TV ad called "Sober Friend" has raised a critical question, particularly for the wide-open West: Can you be charged with DUI for riding a horse while intoxicated?

It’s 2:30 a.m. on a cold Monday night in November and I’m standing on a corner in downtown Hamilton, Montana. The town is shuttered, save our crew of about a dozen setting up lights, a crane arm and giant reflectors beneath a blinking red stop light. We’re shooting Outlaw Rooster’s last scene of the night (or should I say morning?). Rooster is a horse and in this scene, he walks riderless up to the intersection, stops and looks for crossing traffic. As he’d done all night, Rooster nails the take – eight of them, actually – and we wrap the shoot with the usual applause and handshakes.
The commercial for the Montana Department of Transportation stars Rooster as he winds his way through the countryside to a Hamilton bar where he picks up his owner and gets him home safely. The narrator, with a nod to "Friends don’t let friends drive drunk," tells viewers "If you plan to drink, plan to have a friend get you home."

Is riding a horse while drunk legal in Montana?
A Montana Department of Transportation public safety video that features a horse picking up a rider at a bar is intended as a metaphor to encourage drinkers to get a ride home.
But it is being taken literally by some in a state well known for its horse culture.
Helena Police Chief Troy McGee says he’s received many calls from residents wanting to know if riding a horse while under the influence is legal.
