Coffee clash: Investors file lawsuit against Mountain Mudd alleging financial fraud

One year after winning a national award as Montana’s savviest small business, Mountain Mudd http://www.mountainmudd.com/ is being sued for financial fraud by more than two dozen investors, including several prominent Billings business people.

The investors in the coffee kiosk businesses allege owners Brenda Burkhartsmeier and her husband, Dennis Burkhartsmeier, have moved millions of dollars around in three Mountain Mudd corporations and diverted money for their personal use.

One allegation is that they used company money and employees to build a lavish, six-room cabin on 12-acre site in Cooke City.

Investors are seeking $2.64 million, plus punitive damages and court costs.

In an interview Thursday, Brenda Burkhartsmeier said the current financial problems are out of her and her husband’s control. She blamed the problems on a pair of Texans who came to Big Sky country with big dreams: building Mountain Mudd into a national company with kiosks in every state, then selling stock and getting rich.
